SMS Terms and Conditions

These SMS Terms and Conditions apply to the MD Truck Services Account Notifications text message program operated by M&D TRUCK SERVICES LLC (doing business as MD Truck Services, "we," "us," or "our"), 4122 Bougainvillea St, West Palm Beach, FL 33406.

1. Program name and description

Program name: MD Truck Services Account Notifications. MD Truck Services is a car-hauling dispatch company. We dispatch vehicle transport loads for carrier companies (for example DHH Transport or Upper Hunt). Through this program we send account notifications by text message to the broker, shipper or dealer contact on each load. Every message starts with "MD Truck Services for" and the name of the carrier on that load's contract, so you always know who is texting and why. Messages are about your loads, including payment status, invoices, delivery confirmations, bills of lading (BOL) and other paperwork, and payment follow-ups. We do not send marketing or promotional messages through this program.

2. How you consent (opt in)

We only text you after you agree by phone and then confirm by text. Having your number, for example from a rate confirmation or dispatch sheet or because you gave it to us for payment and paperwork follow-up, is not consent by itself.

• Step 1, by phone: on a call with our dispatcher or our phone assistant Cora, we ask: "Can MD Truck Services text you payment and paperwork updates for your [carrier company] loads at this number?" and tell you that you will get one text to confirm, message frequency varies, message and data rates may apply, and you can reply STOP anytime. If you say yes, we record the date, time, phone number, carrier company and call.
• Step 2, one confirmation text: we send a single text that asks you to reply YES to confirm.
• Step 3, reply YES: we send further messages only after you reply YES. If you do not reply YES, we send no more texts.

Consent is not a condition of doing business with us. You can opt out at any time by replying STOP.

3. Message frequency

Message frequency varies with your loads and payment activity.

4. Cost

Message and data rates may apply.

5. Opting out (STOP) and help (HELP)

• Reply STOP to any message to cancel. You will receive one confirmation message, and we will send no further text messages unless you opt in again. Reply START to resubscribe.

6. Carrier disclaimer

Carriers are not liable for delayed or undelivered messages.

7. Eligibility and your number

You confirm that you are the account holder for the mobile number you provide or are authorized to use it for your business. You must be 18 or older to take part. If you change or give up that number, please tell us so we stop texting it.

8. Privacy

Your information is handled as described in our Privacy Policy. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent will not be shared with any third parties.

9. Changes and governing law

We may change these terms from time to time. The effective date at the top shows when they were last changed. These terms are governed by the laws of the State of Florida.
